SMBX is legal?

I have that curiosity because it uses too many things that are property of Nintendo.

SMBX was actually taken down by Nintendo years ago, back when Redigit still ran the website. The reason it's back up is just cause people in the community decided to bite the bullet and just bring it back. I do think Nintendo knows about this though, but although they haven't taken this site down yet they do sometimes demonetize people on Youtube who make SMBX videos.

I wouldn't worry about it though. Until they decide to shut us down you should just enjoy being part of the community (even then we'll probably find a new sparring location)
I shall return with a new episode...... soon.

SMBX was never actually taken down. The domain was seized by Nintendo however there was no "biting the bullet" of sorts, a new domain name was just chosen and people continued on as normal. Nintendo 100% knows that this site exists but there's no reason for them to really care unless people start trying to monetize things on their own

That is really convenient for the community because they do that instead of shut down the site and the game

Basically, fangames are a gray area in legal terms. FREE fangames like SMBX are legal because they don't make money. When they make money, however, is when they are deemed illegal. (Basically paid fangames, fangames with microtransactions, and monetized videos about fangames, which is what got Pokemon Uranium and Pokemon Prism taken down)

The site is not in good standing, and as long as SMBX doesn't "diminish the dignity or value" of Nintendo property they won't mess with SMBX.
As long as one man goes hungry nobody should eat until everyone is full.
